These Terms of Use (“Terms”) govern your use of the Test My Tub mobile application (the “app”). By downloading, setting up, or using the app you agree to these Terms. If you do not agree, please do not use the app.
The app uses artificial intelligence to estimate hot tub and spa water readings (such as chlorine, bromine, pH and total alkalinity) from a photo of a test strip or from values you enter, and to suggest general treatment steps. All outputs are estimates and general guidance.
The app is an informational tool. It is not a substitute for professional water-testing, a qualified pool/spa technician, or medical advice. Readings and treatment suggestions may be inaccurate or incomplete. Always confirm important readings with a separate test before acting on them.
Any status the app shows — including “safe”, “safe to use”, or similar — is an estimate based on the information available to it. It is not a guarantee that the water is safe for you or anyone else. It cannot account for individual health conditions, allergies, or sensitivities (including sensitivity to chlorine, bromine or other chemicals).
You are responsible for deciding whether to enter the water. If you or anyone using your tub has a skin, respiratory, allergic or other medical condition, seek advice from a doctor. If anyone experiences a reaction (such as skin, eye or breathing irritation), stop using the tub immediately and seek medical advice.
Pool and spa chemicals can be hazardous. When handling them you must:
You use the app, treat your water, and handle chemicals entirely at your own risk.
The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including as to accuracy, reliability, or fitness for a particular purpose, to the fullest extent permitted by law.
To the fullest extent permitted by law, Test My Tub and its operator will not be liable for any loss, damage, injury, illness, or reaction arising from your use of, or reliance on, the app or its guidance.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the laws of England and Wales. Your statutory rights as a consumer are not affected.
You agree to indemnify Test My Tub against claims arising from your misuse of the app, your handling of chemicals, or your breach of these Terms, to the extent permitted by law.
Optional subscriptions and scan packs are sold and processed through the app store you installed from — Apple on iPhone and iPad, Google Play on Android — and are subject to that store’s terms. We do not process or store your payment details.
We may update these Terms from time to time. Continued use of the app after changes take effect constitutes acceptance of the updated Terms. The “Last updated” date above shows the current version.
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you have as a consumer in your country of residence.
This section applies only if you downloaded the app from the Apple App Store, and is required by Apple for apps that use their own end user licence agreement.
These Terms are between you and us, not Apple. Apple is not a party to them, and we — not Apple — are solely responsible for the app and its content.
Licence. We grant you a non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
Maintenance and support. We are solely responsible for support for the app. Apple has no obligation to provide any maintenance or support services.
Warranty. We are solely responsible for any product warranties, whether express or implied. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund to you the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever in relation to the app.
Claims about the app. We, not Apple, are responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
Intellectual property. If a third party claims the app infringes their intellectual property rights, we — not Apple — are responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance. You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
Third party terms. You must comply with any applicable third party terms of agreement when using the app.
Apple’s rights. Apple and its subsidiaries are third party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you as a third party beneficiary.
